Terms and Conditions

1. Acceptance of Terms

AiMingle, s.r.o. (“AiMingle”) provides its Service (as defined below) through its website located at https://www.amicited.com (the “Site”) and app.amicited.com (the URL of your account), subject to these Terms and Conditions (“T&C”). Quality Unit, s.r.o. (“Quality Unit”) is a subprocessor of AiMingle, s.r.o. Quality Unit provides certain infrastructure, billing, and support services for the Am I Cited platform. Your agreement is with AiMingle; Quality Unit may act as our service provider and sub-processor.

By accessing or using the Service or the Site, you acknowledge that you have read, understood, and agree to be bound by these T&C. If you are entering into these T&C on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these T&C, in which case the terms “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with these T&C, you must not use the Service.

AiMingle may change these T&C from time to time without prior notice. The revised terms become effective upon posting. If any change is not acceptable to you, your sole remedy is to stop using the Service.

Description of Service

The “Service” includes (a) the Site, (b) the Am I Cited AI visibility monitoring platform, tools and services provided through the Site and by the Am I Cited API, and (c) all software, data, text, images, sounds, video, and content made available through the Site or services (collectively, the “Content”). Any new features that augment or enhance the Service are also subject to these T&C.

The Service enables users to monitor and track how their brands, products, and content appear in AI-generated responses across various AI platforms including but not limited to ChatGPT, Perplexity AI, Google AI, and other AI search engines and assistants.

General Conditions / Access and Use of the Service

Subject to these T&C, you may access and use the Service only for your internal business purposes. You shall not (a) license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service available to any third party, except as expressly permitted; (b) use the Service to process data on behalf of any third party; or (c) use the Service in any unlawful manner or in any manner that interferes with or disrupts the integrity or performance of the Service or its components.

Except for the limited rights expressly granted, all rights, title and interest in and to the Service and its components remain with and belong exclusively to AiMingle. You shall not modify, adapt or hack the Service or otherwise attempt to gain unauthorized access to the Service or its related systems or networks.

You are responsible for all information, data, text, messages or other materials that you post or otherwise transmit via the Service. You are responsible for maintaining the confidentiality of your login and account and for all activities that occur under your login or account. A single login may be used by one person only; you may create separate logins for as many users as your plan allows.

2. Definitions

“User”: Any individual or entity using the Am I Cited Service.
“Service”: The Am I Cited platform, including all features and functionalities for AI visibility monitoring, brand tracking, and analytics.
“AI Platforms”: Third-party AI services that the Service monitors, including but not limited to ChatGPT, Perplexity AI, Google AI/Gemini, and other AI search engines and assistants.
“Monitoring Data”: Data collected by the Service regarding how brands and content appear in AI-generated responses.

3. Usage Terms

3.1 Eligibility

By using the Service, you represent and warrant that you are at least 18 years old or the legal age of majority in your jurisdiction.

3.2 License

We grant you a non-exclusive, non-transferable, revocable license to access and use the Service for personal and business purposes in accordance with these Terms.

3.3 Fair Use

The Service includes limits on the number of queries, monitored brands, and reports based on your subscription plan. Excessive usage that impacts Service performance or exceeds reasonable fair use may result in throttling or additional charges.

4. User Responsibilities

4.1 Accurate Information

You agree to provide accurate, current, and complete information when using the Service and to maintain and update your information as necessary.

4.2 Compliance with Laws

You agree to comply with all applicable laws and regulations when using the Service.

4.3 Brand Monitoring Authorization

You represent that you have the right to monitor the brands, trademarks, and content you configure in the Service. You agree not to use the Service to monitor competitors’ brands for purposes of unfair competition or any illegal activity.

5. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose.
Monitor brands or content you do not have authorization to track.
Attempt to manipulate or game AI platform responses using information obtained from the Service.
Interfere with or disrupt the operation of the Service or servers connected to the Service.
Attempt to gain unauthorized access to any part of the Service, other accounts, computer systems, or networks.
Use the Service to engage in competitive intelligence activities that violate applicable laws.
Resell, redistribute, or commercialize Monitoring Data without authorization.

6. Account and Payment Terms

6.1 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account.

6.2 Payment

If any part of the Service is provided for a fee, you agree to pay the amounts specified and adhere to our payment terms.

6.2.1 Billing changes & updates

The account owner may request updates to invoice billing information within 15 days from the invoice issue date by emailing support@flowhunt.io . A credit memo and updated invoice will be issued where applicable. Requests received after 15 days will apply to future invoices only.

6.2.2 Credit card billing, receipts and privacy

The account owner will receive an email receipt upon each charge. Payments are processed by a third-party payment processor; billing information is handled solely for payment processing in accordance with our Privacy Policy.

6.2.3 Plan and price changes

If you upgrade your plan or increase usage during a billing period, incremental charges may be prorated for the remainder of the term and reflected on your next bill. There are no refunds or credits for partial months of service, plan downgrades, or months unused. Downgrades may result in loss of content, features, or capacity. Prices are subject to change with notice.

6.2.4 VAT ID handling (where applicable)

If you are eligible to use a VAT ID, you are responsible for providing a valid VAT ID in your billing profile. Retroactive refunds for invoices without a VAT ID cannot be issued.

6.3 Logo Usage

By registering for our Service and choosing any plan, you grant Am I Cited the right to use your logo, name, and brand solely for marketing purposes, including but not limited to showcasing your usage of Am I Cited on our website, promotional materials, and presentations. If you wish to opt out of this provision, you may notify us in writing at support@flowhunt.io .

6.4 Refunds and Cancellations

Payments made for the Service are non-refundable unless otherwise required by applicable law. If you wish to cancel your subscription, you may do so at any time; however, no refunds or credits will be issued for partial periods of use.

7. Privacy Policy

Our use of your data is covered by our Privacy Policy , which outlines how we collect, use, and protect your information.

Data Processing

Who is the data processor

For the Am I Cited Service, AiMingle, s.r.o. acts as a data processor on behalf of customers (data controllers). Quality Unit, s.r.o. may act as a sub-processor by providing infrastructure and support services.

What data is processed

We process account information (e.g., name, email, company details), Service usage data, monitored brand configurations, and Monitoring Data as necessary to provide and secure the Service.

Purpose of processing

Data is processed to provide, maintain, secure, and improve the Service; to provide support; to communicate with you; and to comply with legal obligations.

What is the time period of data processing

We retain personal data for as long as necessary to provide the Service and fulfill the purposes outlined above, and thereafter as required by applicable laws, to resolve disputes, and enforce agreements. Upon account termination, personal data is deleted or anonymized within a reasonable period, subject to legal retention obligations.

8. AI Platform Monitoring

8.1 Third-Party AI Platforms

The Service monitors responses from various third-party AI platforms. We do not control these AI platforms, and their responses may change at any time. We make no guarantees about the accuracy, availability, or consistency of data obtained from these platforms.

8.2 No Endorsement

The appearance of your brand in AI-generated responses does not constitute an endorsement by the AI platform providers or by Am I Cited.

8.3 Data Accuracy

Monitoring Data is provided “as is” based on queries to AI platforms at specific points in time. AI responses may vary based on numerous factors including user location, conversation history, and platform updates. We do not guarantee that Monitoring Data represents all possible AI responses related to your brand.

9. Intellectual Property

9.1 Service Ownership

The Service, including all software, algorithms, designs, and documentation, is owned by AiMingle and protected by intellectual property laws. You receive only a limited license to use the Service as described in these Terms.

9.2 Monitoring Data

You retain ownership of your brand information and configurations. Aggregated and anonymized Monitoring Data may be used by AiMingle to improve the Service and for industry research purposes.

9.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by AiMingle without compensation or attribution.

10. Cancellation and Termination

You are responsible for properly canceling your account. You can cancel your account at any time from within the application or by contacting support@flowhunt.io . Upon cancellation, your access will be disabled and your content will be deleted in the ordinary course of business. Information deleted cannot be recovered. If you cancel before the end of your current paid period, the cancellation will take effect immediately and you will not be billed again. AiMingle reserves the right to suspend or terminate your account for any breach of these Terms or unlawful activity, with prior notice where reasonably possible.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM AIMINGLE OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN.

AIMINGLE DOES NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE MONITORING DATA WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIMINGLE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE. IN NO EVENT SHALL AIMINGLE’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNTS PAID BY YOU TO AIMINGLE FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless AiMingle, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

14. Assignment

You may not assign or transfer these Terms, or any rights and licenses granted hereunder, without AiMingle’s prior written consent. AiMingle may assign these Terms without restriction.

15. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in, under the control of, or a national or resident of any country or on any list subject to applicable export controls.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of laws principles. You agree that any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Prague, Czech Republic.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and AiMingle regarding the Service and supersede all prior agreements and understandings.
